PES welcomes ECJ decision on same-sex marriage

The PES is pleased that the EU Court of Justice has decided, in the Coman Case, that the term "spouse" in EU law on freedom of residence for EU citizens and their family members includes spouses of the same sex.

"The decision of the EU court of justice was the right step towards promoting citizens' rights and the freedom of movement in the European Union," said PES President Sergei Stanishev.

"This is a strong signal to all countries that have not yet given same rights to their LGBTI citizens," said Sedef Cakmak, President of Rainbow Rose.

Relu Adrian Coman, a Romanian by nationality, and Robert Clabourn Hamilton, an American citizen, married in Brussels in 2010. After 2 years of struggle, the couple has now welcomed the EU court’s ruling which allows Robert to have a residence permit for Romania as a legal spouse of Adrian.
